1. Acceptance of Terms

By downloading or using Whiskely, you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Who We Are

Whiskely is operated by Abdullah Abdullah. Contact us at support@whiskely.com.

3. Your Account

Whiskely uses third-party OAuth providers (such as Google or Apple) for sign-in. You are responsible for maintaining access to your OAuth account. If you lose access to your sign-in provider, we are unable to recover or transfer your Whiskely account. All activity that occurs under your account is your responsibility.

4. Free Trial

Whiskely offers a free trial period for new users. The trial begins automatically on sign-up. It does not auto-renew and you will not be charged when it ends. Once the trial expires, certain features will become locked until a paid subscription is purchased. You are never charged without actively choosing to subscribe.

5. Subscriptions & Billing

Subscriptions are purchased and managed through the Apple App Store or Google Play Store. Billing, cancellation, and refunds are governed entirely by the respective store's policies — we do not process payments directly and cannot issue refunds or cancel subscriptions on your behalf. Please refer to Apple's or Google's support for billing-related requests.

6. Features & Availability

We reserve the right to add, modify, or remove any features of Whiskely at any time, with or without notice. We will endeavour to communicate significant changes where possible, but continued use of the app constitutes acceptance of any such changes.

7. AI-Generated Content

Whiskely uses artificial intelligence to generate recipes, suggest ingredients, estimate nutritional information, and assist with other cooking-related tasks. You acknowledge that:

• AI can and does make mistakes
• Generated recipes, ingredient lists, steps, and nutritional estimates may be inaccurate, incomplete, or unsuitable for your circumstances
• It is your responsibility to verify all ingredients, quantities, steps, and cooking times before preparing any recipe
• Whiskely accepts no responsibility for any adverse outcomes resulting from following AI-generated content, including but not limited to foodborne illness, allergic reactions, or property damage

8. Rate Limits & Fair Use

To ensure a reliable experience for all users and prevent abuse, we apply rate limits to certain features including AI-powered functionality. These limits apply to all users, including those on paid plans, and are designed solely to protect service reliability and prevent misuse. Attempting to circumvent these limits is a violation of these terms and may result in account suspension.

9. Acceptable Use

You agree not to:

• Use Whiskely for any unlawful purpose
• Attempt to reverse engineer, scrape, or extract data from the app or its underlying systems
• Use AI-generated content from Whiskely for commercial resale or redistribution
• Attempt to bypass, disable, or circumvent any security, rate limiting, or access control measures
• Interfere with or disrupt the integrity or performance of the service

10. Termination

We reserve the right to suspend or permanently terminate your account if you violate these terms or engage in behaviour that we determine, at our sole discretion, to be harmful to other users or the service. You may stop using Whiskely at any time and delete your account via the Settings screen.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Whiskely and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability to you for any claim arising from use of Whiskely shall not exceed the amount you paid for your subscription in the three months preceding the claim.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes through the app. Continued use of Whiskely after changes take effect constitutes your acceptance of the revised terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
